淺析我國(guó)馳名商標(biāo)認(rèn)定中的問(wèn)題
摘 要
隨著世界1體化與商業(yè)化程度的不斷提高，馳名商標(biāo)的巨大商業(yè)價(jià)值日益為人們所矚目，并為商業(yè)界人士和法律界人士廣泛關(guān)注。我國(guó)現(xiàn)行法律規(guī)定認(rèn)定馳名商標(biāo)需要考慮的5個(gè)因素還存在1些不足之處，立法機(jī)關(guān)應(yīng)在已有認(rèn)定標(biāo)準(zhǔn)的基礎(chǔ)上，完善現(xiàn)有的認(rèn)定標(biāo)準(zhǔn)。更有學(xué)者提出要用產(chǎn)品質(zhì)量和知名度并重的馳名商標(biāo)雙重認(rèn)定標(biāo)準(zhǔn)模式來(lái)取代現(xiàn)行的認(rèn)定模式，以求得問(wèn)題的解決。

Abstract
With the integration and commercialization of the continuing improvement of well-known trademarks tremendous commercial value of growing attention by the people. and to the business community and the legal profession widespread attention. Chinas current laws and regulations identified famous trademarks must consider five factors still exist some shortcomings, the legislature should have been identified on the basis of standards, improve the existing standard. Some scholars have the product quality and reputation of both well-known trademark double standard models found to replace the existing model finds - in order to seek to resolve the problem.
