刑事附帶民事訴訟若干問題研究

摘 要

刑事附帶民事訴訟是我國訴訟立法的1項重要制度。隨著市場經(jīng)濟體制的完善和發(fā)展，針對我國目前立法和審判中遇到的問題，有必要從刑事附帶民事訴訟的法律性質(zhì)、附帶民事訴訟當事人的確定、附帶民事訴訟的賠償范圍、附帶民事訴訟的價值取向等方面進行研究探討，以便進1步完善我國刑事附帶民事訴訟法律制度。

ABSTRACT

 Civil claim annexed to a criminal case is an important system of litigation legislation of our country. With the perfection and development of market economy system,legislation and trial of our country have some questions. so, in order to solve these questions, we must analyse and reasearch the nature of law, the determination of litigant, the scope of compensation and value orientation of civil claim annexed to a criminal case and so on which could further perfect the law system of civil claim annexed to a criminal case in our country.
