國(guó)際買賣合同的違約救濟(jì)制度
摘要
國(guó)際買賣合同的違約救濟(jì)制度是指在有效的國(guó)際買賣合同1方?jīng)]有按約定履行合同時(shí)，受害方可依據(jù)法律規(guī)定要求對(duì)方或通過(guò)法院判令對(duì)方賠償其所遭受的損失的法律制度。隨著我國(guó)與世界各國(guó)貿(mào)易的迅猛發(fā)展，國(guó)際買賣合同的違約救濟(jì)制度越來(lái)越重要。中國(guó)法對(duì)國(guó)際買賣合同的違約救濟(jì)制度作了規(guī)定，但還存在許多問(wèn)題，影響適用。筆者通過(guò)對(duì)兩大法系的比較研究，吸收它們的立法和司法經(jīng)驗(yàn)，提出了完善我國(guó)國(guó)際買賣合同的違約救濟(jì)制度的建議。

Abstract
The relief of breaking contract for international trade contract system is a systerm that when one or both parties may not do what they promised to do in international contract ,nonbreaching party can sue breaching party for remedy that would place him in the same position financially as he would have been by law .With the development of the trade between China and other nations,the relief of breach of contract for international trade contract systerm is becoming more important.Concrete regulations are made regarding the relief of breach of contract for international trade contract system in Chinese law,but mang issues have an effect on the application of the law.By comparing the relief of breach of contract in the two big Law Systems,the autor puts forward the suggestion of perfecting the relief of contract law system.
